Provisions on Hosting Services
Bluemoon Hosting users are responsible for the data and content they host on the partitions and databases allocated to them. Any type of text, audio and video data (Book, Musical Notes, MP3, Video... etc.), which are in opposition to the laws of the Montenegro and International Intellectual/Artistic Work, Patent and Trademark rights, may be distributed to the public without the permission of the owner of the work and allocated to them. It is not allowed to keep them in the designated disk space. Bluemoon Hosting reserves the right to stop or completely cancel the services it provides to the user when it detects data as defined above.

In the event that the applications that the user runs on the disk partitions and databases allocated to them sabotage the services they share with other users, Bluemoon Hosting reserves the right to stop or completely cancel the services it provides to the user for the safety of other users. In case the Disk Space, Database Space and Data Traffic (Bandwidth) quota capacities of the hosting services are exceeded, the service fees in the excess rate are automatically invoiced and reflected to the user every month, and the invoice notification is sent to the user via e-mail and SMS. In hosting packages with unlimited disk space, the disk space provided to the user cannot be used as backup, corporate/personal storage center, file server, file transfer center. Bluemoon Hosting reserves the right to cancel the service it provides to the user when it detects such use. The last date of payment of Service Excess Fees is 5 working days after the invoice is created. In case the Service Excess Fees are not paid, the services provided may be stopped.

Content related provisions
Bluemoon Hosting is a “hosting provider”. Bluemoon Hosting is not obliged to check the content it contains or to investigate whether there is an illegal activity. However, it is regulated by international and local laws or not regulated by international and local laws, but attacks the values ​​​​considered sacred and spiritual, constitutes public sensitivity, and contains content such as Gambling, Pornography, Hacking, Phishing, Hope Smuggling, SPAM activity and on Broadcasting of websites with a security vulnerability can be stopped without notifying the user. In line with complaints, other notifications or warning systems, Bluemoon Hosting reserves the right to stop or completely cancel the services it provides to the user when it detects unsolicited, offensive, mass e-mails with advertising content. It is recommended that users with service requirements above these values ​​purchase VPS (Virtual Server) service.

Provisions on accounting transactions
The domain name registration expiration date of the products and services belonging to the users, the contract renewal warnings, the user's e-mail address and registered mobile phone are notified by Bluemoon Hosting as a short message 30, 15, 7 days before the deadline or the end of the registration period of the domain name. The product price information in these messages is the product price information on the date the reminder is sent, and the product prices in the payment page and the reminder sent to you may differ due to the time differences between the reminder periods in the periods where price changes are made. Provisions on Refunds
If the user is not satisfied with the products or services he has purchased, he can request a refund within 30 days from the date of sale of the product by using the "E-desk" after-sales support software. Bluemoon Hosting makes the refund directly to the user's credit card or to the bank account number declared using the E-support after-sales support system. It may take 2-3 business days for the money refunds to be made via money order or EFT to the bank account declared by the user. In cases where Bluemoon Hosting cannot reach the User and has to return the product, it transfers the product amount to the user's current account in the "E-desk" after-sales support software as "credit". The user can use this credit to purchase another product or request a refund of the credit in his current account.

Users, whose credit card has been charged excessively due to a user-related, bank-related or software-related problem, are obliged to declare this incident and refund request in writing using the "Edestek" after-sales support software. Following the user's declaration, the necessary refund will be made to the user's credit card. Otherwise, Bluemoon Hosting cannot be held responsible for any loss or damage that may occur to the user. In case the user cancels the sale without informing the Bluemoon Hosting operators, the products and services sold based on the "Charge Back" notifications to be returned from the bank may be retained by Bluemoon Hosting and the user account may be suspended.

Only right holders can apply for domain names with "Registered Trademark or Patent" names. In the approval and confirmation processes of SSL certificates, the applications of domain names with the names "Registered Trademark or Patent" may be rejected if the applicant is not the owner of the right. These inspections are performed by VeriSign automatically and in two stages with expert analysis. It is not possible to make an exception to the audit result, object to it or question the decision. For this reason, the payments of the applications that are negative will be returned to the user.

In cases where SSL Certificates are installed incorrectly by the user on their computer by not following the installation guides provided by Bluemoon Hosting, or if the private key created on their own computer during the Certificate Signing Request is generated, a new certificate is provided to the user within 7 days from the first sale of the product. Fees cannot be refunded.

Cancellation and refund are only valid for new purchases, renewals and package changes are not within the scope of cancellation and refund.

Refund of domain name registration products, VPS (Virtual Server) packages, SSL Certificates and Software License products is not possible in terms of execution and is outside the refund conditions.

Provisions regarding domain name registration services
Domain name registration products can be provided on the "first come, first served" basis. Distribution of registration rights is provided by USA based ICANN (www.icann.org). Domain name registration databases on root servers managed by ICANN are updated every 8 hours. A product purchased through Bluemoon Hosting can be ordered from another supplier and through a different user, 1-2 hours apart. In such cases, arising from the databases' update period, it may occur that the domain name in question cannot be registered by Bluemoon Hosting. In such cases, the user is refunded and the provisions regarding the refund are applied.

Domain name registration products, for which an order is created with a transfer commitment, may not be available to the user who makes the transfer commitment due to delays that may arise from the receipt verification of the orders created with the transfer commitment. The same product can be ordered by a different user using a credit card.

It can be purchased instantly through Bluemoon Hosting or another supplier by ordering. For this reason, there is no guarantee for the domain name registration products to be ordered with a transfer commitment, for the products to be provided to the users for which the order is created with a transfer commitment. Domain name registration services are provided by Bluemoon Hosting Inc, Delaware USA, accredited by ICANN. .com, .net, .org. info, .biz, .info proprietary products are from the USA, the service is from the USA. All operations of these domain names are carried out in the USA, all operations, transfers and pricing are controlled by US laws and ICANN provisions. All disputes and disputes regarding US origin domain names such as .com .net .org ... can only be resolved by trusted arbitral tribunals or courts appointed by ICANN. Decisions made by other decision makers can only be evaluated within the framework of international law. Dispute procedures and regulations are announced and updated by ICANN at this address: https://www.icann.org/resources/pages/help/dndr/udrp-en. Operations and flow of operations related to domain names of US origin may vary. Domain names whose registration has expired and whose registration has not been renewed by the user (domain names with the extension .com .net .org .info ...etc., which are subject to ICANN control) fall into the "Renewal Suspension" period. The “Renew Grace Period” is 40 days for .COM, .NET .ORG and .INFO domains. Bluemoon Hosting is the domain name owner unless the user does not renew during the Renewal Hanger process. During this period, when the user is renewed, the domain name is transferred to the user and opened for use.

Domain names that have not been renewed during the renewal suspension period (at the end of 40 days) pass into the "Deletion Hanger" period. The recovery process fee is 99 USD for domain names that are within this period and are to be renewed. You can find the domain name price list here.

Provisions regarding VPS (Virtual Server) services
VPS virtual server services consist of server and server resources allocated to the user by Bluemoon Hosting. Internet, virtualization platform etc. of Bluemoon Hosting virtual server infrastructure. Responsible for ensuring continuity of services.

The operating system running on the virtual server provided to the user and the services running on the operating system are the responsibility of the user. Users are authorized to access partitions in the entire system. VPS service can be considered as a dedicated server service. Bluemoon Hosting is not obliged to control the content for the virtual server services it provides to its users, but reserves the right to pause or completely cancel the service provided to the user in case of performing illegal activities on our servers as specified in the "Content-related provisions" in the General Terms of Use.

Provisions regarding Data Backup Services
Bluemoon Hosting backs up the data they contain in the partitions and databases allocated to its users in various ways. However, Bluemoon Hosting has limited liability for backing up users' data. The value and importance of the data can only be appreciated by the user. Data of high value and importance should be backed up more frequently by the user. Bluemoon Hosting cannot be held responsible for the losses that may occur in the data they contain in the disk partitions and databases allocated to its users.

Each user can periodically back up the data they contain in the disk partitions and databases allocated in the control panel provided to him, as a single file, and transfer it to his personal computer. How to do this is in the Bluemoon Hosting user manuals.

Bluemoon Hosting periodically takes image backups of the general services and systems it provides. These backup files may only be used by Bluemoon Hosting for reconstruction purposes in case of major system problems. Restore backups of user content from these backups may not reach.

In case of data loss, it is necessary to make a notification using the "Support" after-sales support software within 12 hours at the latest from the moment of the incident in order for the users to compensate for the data loss. It may not be possible to compensate for data loss in later notifications.

Provisions regarding User Privacy
Bluemoon Hosting acknowledges that the information provided by users when creating an account is correct. Bluemoon Hosting reserves the right to seize the accounts of these users and to suspend the services provided by them until they provide their real identity or contact information.

Bluemoon Hosting records every movement of the users on the "Support" after-sales support software and the IP address of the movements for security purposes.


When required, Bluemoon Hosting authenticates users by using the GSM, fixed phone and e-mail addresses declared by the users. In the event that all the information declared by the user is changed, the user is obliged to present physical identification. Otherwise, it is not possible to take any action regarding the user account.

Users who unintentionally misrepresent any of their e-mail, telephone or GSM information, or users who have changed their declared information, shall support this information. They are responsible for correcting it by logging into their .com account.

The user is responsible for the security of all user information, passwords and passwords provided to him by Bluemoon Hosting. Bluemoon Hosting cannot be held responsible for any damages that may arise if these passwords and passwords are in the hands of third parties. If the user forgets their password information, they can send this information as a message to the registered e-mail address or registered GSM number using the "Support" after-sales support software. Bluemoon Hosting cannot be held responsible for any problems that may arise as a result of the e-mail address or GSM number registered on behalf of the user changing hands.

Bluemoon Hosting is not a judicial authority. Parties in conflict over user accounts on Bluemoon Hosting should resolve the situation by taking them to court. When Bluemoon Hosting deems it necessary, it may pause the account and the products linked to the account and request official document statements from the parties in order to identify the real owner of the account. In line with these statements, Bluemoon Hosting transfers the account to one of the parties. If the dispute continues, the party claiming rights on the account should apply to the relevant judicial authorities.

With this agreement, Bluemoon Hosting may refer to all the institutions, organizations and brands it serves as a reference in its other projects or may publish the institutions and organizations it references on its website. Institutions or organizations that do not want to be disclosed as a reference should notify "Customer Services" through the website after-sales support system. The relevant institution is removed from the reference list within 72 hours following the notification.

Provisions regarding After Sales Support
Bluemoon Hosting's commitment to after-sales support for the products it provides to its users is limited to the terms defined here. The main duty of Bluemoon Hosting consists of the healthy functioning of the services it provides to the users. Bluemoon Hosting operators monitor the services provided to users 24 hours a day, 7 days a week. Bluemoon Hosting is committed to a 99% Service guarantee. This commitment states that the total of interruptions in a year will not exceed 82 hours. Bluemoon Hosting undertakes that user-related problems will be resolved within 7 days at the latest (Virtual Server services are excluded from this scope). Bluemoon Hosting does not make a commitment to solve the problems that are not caused by itself or the user. For problems that cannot be resolved with the user manuals, all users are obliged to submit their problems and requests in writing using the "Support" after-sales support software.
